These terms are the agreement between you and Eva for use of the Eva apps and website. Please read them. If you use Eva, you accept them.
The short version. Eva is software that salons use to run their business. Eva is not your salon. Your appointment, your service, what you pay, and what your reward points are worth are all between you and the salon. Use the app honestly, and either of us can end this arrangement at any time.

1. Accepting these terms
By creating an Eva account or using the Eva apps or website, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Eva.
You must be at least 18 years old, or old enough to enter a contract where you live, to create an account. If you are booking on behalf of a minor, the account must be yours.
2. What Eva is
Eva is a software platform for nail and hair salons in the United States. It includes an app for salon customers (booking, check-in, offers, reward points, gift cards, and messaging with the salon), apps used by salon owners and staff, and an assistant that can answer a salon’s phone and reply to messages on the salon’s behalf.
Some replies you receive in the app or by phone are generated automatically rather than written by a person. The app labels these. Automated replies can be wrong or incomplete. For anything that matters — a price, an appointment time, whether the salon is open — confirm with the salon.
3. Eva is not your salon
This is the most important thing in this document, so it gets its own section.
Eva provides software to salons. Eva does not own, operate, employ, supervise, or control any salon or any technician. When you book through Eva:
- Your agreement for the service is with the salon, not with Eva.
- The salon sets its own prices, hours, staff, cancellation rules, and refund policy.
- The salon is responsible for the service you receive, for its licensing and insurance, and for health and safety at its premises.
- If something goes wrong with a service — the result, the cost, an injury, a no-show, a dispute over a refund — that is between you and the salon. We will help where we reasonably can, but Eva is not a party to it.
Information shown in the app — services, prices, hours, technicians, photos, descriptions — is supplied by the salon. We do not verify it and it can be out of date.
4. Your account
You sign in with your mobile phone number and a code we text you. You agree that:
- The number you enter is yours. Do not sign up with someone else’s number.
- You will keep your device and verification codes to yourself. Anyone with your phone and your code can reach your account, your reward points, and your gift cards.
- The information you give us is accurate, and you will keep it current.
- You will tell us promptly at eva@eva-solution.net if you think someone else has access to your account.
If you give up a phone number, delete your Eva account first. Numbers get reassigned to new people. If your old number is reissued and your account is still attached to it, whoever receives that number could sign in and see your information.
5. Text messages
By entering your phone number you agree to receive text messages from Eva and from salons you use, including verification codes, appointment confirmations and reminders, and service updates. Message and data rates may apply.
You can reply STOP to a marketing message to opt out of marketing. Verification codes and messages about an appointment you booked are part of the service and are not marketing — if you block them you will not be able to sign in.
6. Appointments and check-in
A booking made through Eva is a request to the salon. The salon may confirm, reschedule, or decline it. Wait times shown in the app are estimates and are not guaranteed.
Cancellation windows, late policies, no-show fees, and deposits are the salon’s rules. Ask the salon what they are. If you cannot make an appointment, cancel in the app or call the salon.
QR check-in codes and beacon check-in are for use at the salon. Do not photograph a check-in code and use it from somewhere else; codes expire quickly for this reason, and misuse may cost you your account.
7. Reward points, offers, gift cards
Reward programs, offers, and gift cards in Eva belong to the salon that issued them, not to Eva.
- Each salon decides how points are earned, what they are worth, what they can be redeemed for, and whether they expire. It can change or end its program.
- Points and offers are valid only at the salon that issued them, and have no cash value.
- Gift cards are a commitment of the issuing salon. Eva does not hold the funds and is not responsible for honouring them. If a salon closes or stops using Eva, its points and gift cards may become unusable, and your recourse is with the salon.
- Points earned in error, through a fault in the system, or through abuse may be corrected or removed.
8. Payment
The customer app does not take payment. You pay your salon directly, by whatever means the salon accepts. Eva does not process, hold, or refund payments for salon services, and refunds are handled by the salon under its own policy.
Eva is free for salon customers. Salons pay for the platform under a separate agreement.
9. Acceptable use
Do not:
- Use someone else’s phone number, or impersonate another person or a salon.
- Make bookings you do not intend to keep, or book repeatedly to disrupt a salon.
- Send threatening, harassing, hateful, sexually explicit, or unlawful messages or images through the app.
- Try to break, probe, overload, or reverse-engineer the service, or get at data that is not yours.
- Use automated tools to access the service, or scrape it.
- Reuse, forge, or share check-in or redemption codes outside their intended use.
We may suspend or close an account that breaks these rules, and where the behaviour is serious we may report it.
10. Content you send
You keep ownership of the messages and photos you send. You give us permission to store and transmit them so we can deliver them to your salon and operate the service. You confirm that you have the right to send what you send.
Messages between you and your salon are visible to the salon’s staff. Do not send payment card numbers, government identification numbers, or medical information through the chat.
11. Our intellectual property
The Eva apps, website, software, name, and logo belong to Eva and are protected by law. These terms give you permission to use the apps for their intended purpose; they do not give you ownership of anything, and you may not copy, modify, resell, or create derivative works from the service.
12. Availability and changes
We work to keep Eva running, but we do not promise it will be uninterrupted or error-free. The service depends on things outside our control, including your device, your network, mobile carriers, and third-party providers.
We may add, change, or remove features. If a salon stops using Eva, its salon page and rewards will no longer be available in the app.
13. Ending your use of Eva
You can delete your account at any time — see the Privacy Policy, which also explains exactly what is and is not deleted.
We may suspend or close your account if you break these terms, if we are required to by law, or if we stop offering the service. Where we reasonably can, we will give you notice.
Sections that by their nature should survive the end of this agreement — including sections 10, 11, 14, 15, and 16 — continue to apply.
14. Disclaimers
To the fullest extent permitted by law, Eva is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, secure, or error-free; that information supplied by salons is accurate or current; that automated replies are correct; or that arrival estimates, wait times, or notifications will be timely or delivered at all.
We make no warranty about any salon or about any service you receive from a salon.
15. Limitation of liability
To the fullest extent permitted by law, Eva and its officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost reward points or gift card value, missed appointments, or loss of goodwill, arising out of or relating to your use of Eva — whether the claim is based in contract, tort, or any other theory, and even if we were told such damages were possible.
To the fullest extent permitted by law, our total liability for all claims relating to Eva is limited to one hundred United States dollars (US$100), or the amount you paid Eva in the twelve months before the claim, whichever is greater. Because the customer app is free, that amount is typically zero.
Some states do not allow the exclusion of certain warranties or the limitation of certain damages. In those states, the exclusions and limits above apply only to the extent the law allows, and nothing here limits liability for fraud, or for death or personal injury caused by negligence, where the law does not permit that limit.
16. Governing law and disputes
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You and Eva agree that any dispute will be brought in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts. Nothing here prevents you from bringing a claim in small claims court, or from making a complaint to a regulator.
Before filing anything, please email us at eva@eva-solution.net. Most problems are faster to fix that way.
17. Changes to these terms
We may update these terms. We will change the “last updated” date, and for significant changes we will tell you in the app or by text or email. If you keep using Eva after a change takes effect, you accept the updated terms. If you do not accept them, delete your account.
